GoHorseShow.com just talked to Maddi Williams who was hired as a consultant by Federal Bankruptcy Trustee Mark Weisbart to deal with the selling of all the Babcock frozen semen that is available from such outstanding studs as Smart Chic Olena, Trashadeous, Cowboy Smarts. The semen is currently being stored at Select Breeder’s Southwest in Aubrey, Texas. The 200 head of horses that were auctioned off late last year were bought by a church in Oklahoma, reports say in the $200,000 dollar range for all of the horses– these horses are not involved in this dispersal of assets.

SALE OF BABCOCK FROZEN SEMEN AND EMBRYOS

What is being sold?

Frozen semen and embryos owned by the bankruptcy estates of Jim Babcock and Babcock Quarter Horse Ranch (“Sellers”) pursuant to an order approved by the Bankruptcy Court for the Eastern District of Texas, Sherman Division on February 9, 2011. A list of the frozen semen and embryos is attached.

What is the quality of the semen?

Some of the frozen semen has resided with Select Breeders Southwest, Inc. since 1999 (the “SB Doses”). For example, most of the frozen semen from Smart Chic Olena was collected between 2001 and 2004. That semen has been tested for motility by Select Breeders and only commercially acceptable doses are being sold. Other semen was retrieved from Babcock Ranch in September 2010 and delivered to Select Breeders (the “Ranch Doses”). Random DNA and motility tests have been run on that semen.

Can I select which doses I want to purchase?

No. Except for doses which have been approved for overseas transport, the doses will be sold in pairs, one dose coming from the SB Doses and the other dose coming from the Ranch Doses. The doses you buy will be randomly selected from each grouping.

Are there any guarantees?

Sellers make no guarantees that a live foal will be born from the semen or embryos and there are no rights to a re-breed. The semen and embryos are being sold “as is, where is” without any representations or warranties. There is no recourse against Sellers related to a purchase of the semen or embryos and the Bankruptcy Court has retained exclusive jurisdiction to resolve any issues, questions or disputes related to such sale.

Will I be able to register the resulting foal(s) with the AQHA

or will I get a breeder’s certificate?

Each buyer of eligible semen or embryos will have the right to purchase retained semen or embryo rights permits with the purchase of the semen and/or embryos. One permit may then be used in place of a breeder’s certificate for registering one foal with the AQHA. The buyer will decide how many permits he/she wants to purchase with the semen/embryos being obtained. For example, if you buy 2 doses and pay for 6 permits you can register 6 horses produced from those doses. However, if you buy only 2 permits and produce 6 horses from those doses, only 2 horses can be registered with the AQHA. No additional permits may be obtained after the sale is concluded. The cost of the permits is $65.00 per permit, and there will be no refunds for the purchase of these permits. You will be responsible for submitting the permit along with all other paperwork and other information to register your foal to AQHA. You will also be responsible for submitting the stallion report to the AQHA at the time you inseminate your mare with the semen. At this time, the AQHA has informed us that it will not register foals resulting from frozen semen or embryos of certain horses, which will be clearly identified on a separate listing. If you wish to purchase semen or embryos from this list, you understand that the resulting foal will not be eligible for registration with the AQHA.

Trashadeous – APHA Registration

If I buy Trashadeous semen and get a paint foal, will I be able to register the foal with the American Paint Horse Association?

The American Paint Horse Association has informed us that buyers who purchase frozen semen from Trashadeous will be able to register the resulting foal with the American Paint Horse Association if the foal otherwise meets the registration requirements of the APHA, and the buyer obtains a semen permit from the APHA before the buyer uses the semen. The buyer will be responsible for contacting the APHA and obtaining the semen permit along with the requisite fees. We understand the current fee is $100.00. This is a different permit and fee from the permit and fee required by the AQHA for AQHA registration. At the time of sale, we will ask each buyer of Trashadeous semen for authorization to submit the buyer’s name and other contact information to the APHA after which it will be the buyer’s responsibility to follow up with the APHA and obtain the permit(s) if the buyer wishes to qualify any resulting paint foal for APHA registration.

Delivery of the doses

At the time of sale, a bill of sale will be signed and the doses will be transferred to you as of funding. Checks should be made payable to Mark A. Weisbart, Trustee. You will then assume all responsibility for coordinating with Select Breeders concerning the continued storage, delivery or use of your doses for breeding and will be responsible for all such costs after closing.

Overseas Doses

A limited number of the SB Doses are approved for transport overseas. These doses will be marketed and sold on a per dose basis.
